Through our Privacy Policy, we are committed to protecting our users’ personal data. We are also working to introduce new features in our controls to provide all our users with greater protection of their personal data.

1. Controller:

The personal data will be controlled by GRUPO AC MARCA, S.L., with tax number B- 61.711.503 and with its offices at Av. Carrilet, 293-297, 08907 L’Hospitalet de Llobregat (Barcelona), Spain, which is the parent company of the AC MARCA business group.

AC Marca includes both GRUPO AC MARCA, S.L. and any company directly or indirectly controlled by it.

Therefore, this Privacy Policy applies to personal data collected by AC Marca companies in relation to its products and services.

2. Addressees:

AC Marca shares personal data internally and with third parties that necessarily require access to them, such as external service providers contracted specifically for this purpose or in complying with a legal obligation.

3. Personal Data collected by AC Marca:

The personal data are collected to provide the services that we offer to all our users.

The users’ personal data are collected through two procedures:

1. Information provided directly by the user through forms: for example, contact information (Name, Surname, Email, etc.)

2. Data obtained through the use of AC Marca services: data can be collected on what services are used and how.

4. Purpose of the Processing:

The personal data collected through our services is used to provide, maintain, protect and improve said services, develop new services and ensure the protection of our users and the AC Marca Companies.

In compliance with the provisions of the GDPR, when users are asked to complete a form with their personal data, they will be informed about the addressee of the information, the purpose for which the data are collected and the user’s faculty to exercise their rights. The collected personal data will only be processed for the purpose indicated by the AC MARCA Companies, and always with the free and unequivocal consent of the user.

5. Period of Conservation of Personal Data:

Personal data will be kept for as long as the purpose for which they were collected, and will always be subject to the principle of limitation of data conservation, or until the user requests their deletion, and always for the time necessary to fulfil the legal obligations.

6. Legitimation:

The legal basis or legitimacy for the processing of personal data lies in the express consent that the user grants to the AC Marca Companies for the purposes indicated in each case.

7. Security Measures and Access Controls:

AC Marca has taken all technical and organisational measures necessary to guarantee the security and integrity of the personal data it processes, and to prevent their loss, alteration and/or access by unauthorised third parties.

AC Marca’s websites use information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data.

To achieve these purposes, the user agrees to AC Marca obtaining data for the authentication of access checks.

8. User Rights:

The user has the right to receive confirmation from AC Marca of whether or not their personal data are being processed.

They are also entitled to access their personal data and to request the rectification of inaccurate personal data, or, if applicable, to request the deletion of their data when, among other reasons, they are no longer necessary for the purposes for which they were collected.

Under certain circumstances, users may request the limitation of the processing of their data, in which case they will only be kept for the exercise or defence of claims, or may oppose the processing of their data. AC Marca will stop processing the data, except for compelling legitimate reasons or for the exercise or defence of possible claims.

Likewise, users can exercise the right to data portability, and to withdraw the consents provided at any time, without this affecting the legality of the treatment based on the consent prior to its withdrawal.

The user may exercise the aforementioned rights by sending an email to dpo@acmarca.com and providing the following information along with it: Name and surname, email address and channel through which the data were provided.

9. Minors:

AC Marca does not collect personal data from users under 18 years of age without the consent of the holder of parental authority or guardianship over the minor.

AC Marca accepts no liability if minors have sent personal data through this website, since the forms are directed exclusively to people of legal age.

10. AC Marca Commitment:

All the data requested through the AC Marca websites are mandatory, as they are necessary to give users an optimal service. If not all data are provided, AC Marca does not guarantee that the information and services provided might adapt completely to users’ needs.

AC Marca will not limit the rights of users under this Privacy Policy without their express consent.
